ALL BIDDERS HEREBY CERTIFY THAT THEY HAVE READ AND FULLY UNDERSTAND THE TERMS AND CONDITIONS LISTED BELOW AND THEY AGREE TO BE BOUND THEREBY. EACH AUCTION MAY HAVE ADDITIONAL TERMS THAT ARE NOT LISTED HERE. IT IS THE BUYER’S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO SUBMITTING ANY/ALL BIDS.

Buyer’s Premium
5% Buyer’s Premium Fee, Not To Exceed $5,000.00 Per Individual Item

Internet Bidding
This is an Internet Auction, the highest bid online when the bidding closes will be the winning bid for the item, unless the particular item has a posted reserve price and the reserve price has not been met, in which case the item will not sell. Bidding within the last 60 seconds before the closing of an item will extend the bidding time by an additional 60 seconds. Be prepared to bid accordingly. No fictitious bidding by the sellers will be allowed

Equipment Sold “As Is, Where Is”
All equipment /property is sold “AS IS, WHERE IS” with no warranty or guarantees, expressed or implied, by the seller or Del Peterson & Associates. ALL SALES ARE FINAL. Inspection of the property/equipment before bidding is strongly recommended. Verbal or written descriptions from the seller or Del Peterson & Associates are not guaranteed. Bidders are responsible for inspection of the items and will not be issued a rebate or refund for any reason. It is the responsibility of the buyer to conduct any inspection and examination necessary to satisfy him/her of all material facts before placing any/all bids. Location of the equipment and the seller’s contact information will be provided within the description of each item for sale.

Bidders accept all auction items/property “WITH ALL FAULTS”, whether or not immediately apparent. Bidders are responsible for assessing actual current condition of the item(s)/property through personal inspection and careful review of the description, picture(s), and/or support documentation. Every bidder agrees that by placing a bid and the amount that he/she bids, has been based solely on his/her own independent inspection and evaluation of the auction item.

Pictures
Del Peterson & Associates Employees and Sales Representatives are not professional photographers. Photos may or may not depict all the positives and negatives of an item. These photos and descriptions are to be used as a guideline only. All bidders are responsible for their own personal inspection of the item(s).

Odometer/Mileage/Hours
Odometer, Mileage & Hour Meter are assumed to be correct. However, these assumptions do not constitute a guarantee. It is up to the BUYER to validate the accuracy of the reading during the inspection process. Del Peterson & Associates is not liable for any inaccuracies pertaining to odometer, mileage and hour meter readings.

Auction Software
Del Peterson & Associates will not be held liable for any software or software malfunction discrepancies.

Invoicing
An invoice with payment instructions will be sent to each buyers registered email at the close of bidding. IF you do not receive an invoice via your email within 24 hours after the close of the auction, please contact us @ (800) 492-9090 immediately.

Successful Bidders/Payment
Successful bidders must contact Del Peterson & Associates within 24 hours after receiving their invoice to confirm their method of payment.

1. Payment(s) must be received within 7 days after the conclusion of the auction.
2. Any payment(s) received between 7 to 14 days after the conclusion of the auction will be assessed a 3% late fee on the invoice total.
3. If payment(s) is not received within 14 days after the conclusion of the auction, the buyer will lose all right, title and interest to the property, including any and all moneys.

No equipment will be released until payment is made in full. Failure to comply with these terms will result in buyer “NOT TO PARTICIPATE” in future live or on-line auctions conducted by Del Peterson & Associates.

Equipment Removal
Removal and/or transportation of equipment shall be at the expense, liability and risk of the buyer. Any Items not removed within 3 weeks of the conclusion of the auction, unless otherwise stated in the terms of the auction or description of the item, will be considered abandoned and the purchaser will lose all right, title and interest to the property, including any and all moneys from the buyer. Once full payment(s) has been received, Del Peterson & Associates will issue a PAID AUCTION RECEIPT to the buyers registered email address, which will contain a Verification Code. The buyer will then contact the seller (seller information provided on the PAID AUCTION RECEIPT) and provide the verification code for equipment release.

Returned Check Fees
A fee of $50.00 will be assessed on returned checks and the bidder denied access to future auctions. Be sure you are capable of paying immediately after the conclusion of the auction and realize your bids are not conditional upon financing, unless the sale of an item is indicated otherwise.

Payment Procedures:
Payments will be made directly to Del Peterson & Associates, not to the sellers.

*For purchasers within the continental United States, methods of payment include: Company/Personal Check, Direct Wire Transfer or Credit Card (with a 2.75% fee for use of a credit card).

*For purchasers outside the continental United States, we ONLY accept payment by Direct Wire Transfer or Credit Card (with a 2.75% fee for use of a credit card).

Taxes
Del Peterson is required by law to collect sales tax on all applicable transactions. Tax rates will be based on the item’s location. Tax will be collected on all applicable items unless the buyer provides proof of a tax exemption. This proof of tax exemption must be submitted before tax amounts will be removed from the invoice. Law requires that exemption forms are auction specific and will need to be completed for each event. Del Peterson & Associates cannot offer advice, opinions or guarantees about whether a bidder is in fact exempt. For eligibility questions, please contact your tax consultant. Del Peterson & Associates will not be held liable for States’ registration requirements in regards to exemptions. Guidelines and regulations regarding tax exemptions may vary between states. If you are eligible for an exemption, please complete the appropriate exemption certificate and email it to auction@delpeterson.com or fax it to 402-721-4583

Titles
Titles will be sent out by Priority Mail no sooner than 14 days after the conclusion of the auction, unless otherwise specified in the description of the item
